EFF Dissects the Gizmodo Warrant
Electronic Frontier Senior Staff Attorney Matt Zimmerman says that
Federal and California law both protect reporters against police
searches aimed at uncovering confidential sources or seizing other
information developed during newsgathering activities. Yet on Friday,
agents with the Rapid Enforcement Allied Computer Team (REACT) executed
a search warrant at Gizmodo editor Jason Chen's home, searching for
evidence related to Gizmodo's scoop on what appears to be a prerelease
version of Apple's next iPhone model. The warrant does not reveal
whether Chen himself is considered a criminal suspect, or what alleged
crime the police are investigating, but Chen was not arrested. All of
his computers and hard drives (among other materials) were seized for
further search and analysis.
Zimmerman contends that under California and federal law, this
warrant should never have been issued, and it likely violates the
Privacy Protection Act, observing that the police appear to have gone
too far, with the REACT team, "a partnership of 17 local, state, and
federal agencies" with a "close working partnership with the high tech
industry," seeming to have leapt eagerly to Apple's aid before it
looked at the law, putting the presumed interests of an important local
company before rights guaranteed by law.

Dissecting the Gizmodo Warrant
Rush Limbaugh: The Fascinating Case of the Lost
iPhone
Conservative talk radio personality Rush Limbaugh, a longtime Mac
computer aficionado, holds forth on the Gizmodo/Lost 4G iPhone saga,
noting:
"...Apple asked for the phone back, and the Gizmodo guys, 'Okay, but
we want your request in writing.' So Apple's legal counsel sends the
request in writing. Now, you Gizmodo guys, and you Gawker guys
[editor's note: Gawker Media owns Gizmodo], this is where you erred.
Your response to Apple's letter was juvenile and snarky and totally
unnecessary. I don't know that Apple is behind these charges that had
been brought or might be brought against one of the Gizmodo editors,
because this is a criminal, not a civil complaint. Apple may not have
any control over whether or not the DA out there levels charges. If it
was a civil case then Apple could say, okay, go after 'em or not go
after 'em, but if it is a criminal case, if the DA out there thinks
that Gizmodo essentially knew it knowingly bought a stolen phone,
traded in stolen merchandise, then the Gizmodo editor, Jason Chen, may
not be protected by the Shield Law. The Shield Law says that
journalists cannot be charged and cannot have search warrants executed
against their home or their office or whatever, but in this case, if
it's stolen property, if that's the angle the cops are going for then
the Shield Law may not apply, and this little editor could be in for
some trouble....'
"....One more thing on this Gawker-Gizmodo-Apple new 4G iPhone
thing. .... The guy in the bar who found the phone on the bar stool did
try to return it to Apple. He called tech support. He called every
number that you can find for Apple, and everywhere he called the people
didn't know what he was talking about, assumed he was a kook, and hung
up on him - or thanked him and sent him away."

Nearly 30% of 1G iPhones Still In Use
AppleInsider's Neil Hughes reports:
"Just 2 percent of all iPhone OS handsets* still in use are Apple's
first-generation iPhone, but a new calculation estimates that amounts
to nearly 30 percent of the 6.1 million iPhones sold between June 2007
and July 2008."
* That includes the iPod touch, not just iPhones. AdMob calculates
that 40% of iPhone OS traffic comes from the iPod touch, 60% from the

Kaspersky: iPhone's Long-term Future Bleak
PC Advisor's Rosemary Hattersley reports that the death of the
iPhone is being foretold, with the projected outlook for both desktop
PCs and laptops not much better, according to company CEO and founder
of Kaspersky Lab, Eugene Kaspersky, who thinks both are set to be
consigned to history.
Kaspersky predicts that the Apple will cease to exist or occupy a
much smaller niche by five years from now, and that of the five main
mobile platforms currently in existence, the only two guaranteed to
last beyond the next five years are Android and Symbian.
He also believes that open source platforms will outlast closed
systems such as the iPhone OS, BlackBerry OS, and Windows Mobile, and
that if they hope to survive, closed systems must change their approach
and drop restrictions on developers, adding that if Apple refuses to
change its approach, the iPhone will morph into niche product for
die-hard Apple fans, no longer a mass market product, an outcome
Kaspersky suggests Steve Jobs would be content with.

Opera Mini: The Impact of the iPhone
In just two weeks since its release, the iPhone is already the
third-most popular handset for Opera Mini users worldwide, according to
Opera's State of the Mobile Web Report. The release of the iPhone
version also portends changes to the top 10 list. According to
preliminary numbers, the United States may soon have the fifth-most
Opera Mini users, displacing Nigeria, South Africa and Ukraine on its
ascent up the list.
Opera's State of the Mobile Web Report, published monthly, provides
information on the top global trends affecting the mobile Web. The full
report is available from opera.com (English only). In addition to a
short preview of the iPhone's impact, the report highlights global
statistics, reviews the mobile browsing trends in the European Union
(EU) and includes a look at worldwide handset metrics.
Global trends
- In March 2010, Opera Mini had over 55.2 million users, a 9.3%
increase from February 2010 and more than 140% compared to March
2009.
- Those 55.2 million people viewed more than 25.8 billion pages in
March 2010. • Since February, page views have gone up 17.4%.
Since March 2009, page views have increased 200%.
- In March 2010, Opera Mini users generated over 396 million MB of
data for operators worldwide. Since February, the data consumed went up
by 19.8%. Data in Opera Mini is compressed up to 90%. If this data were
uncompressed, Opera Mini users would have viewed over 3.6 petabytes of
data in March. Since March 2009, data traffic is up 166%.
- The top 10 countries for Opera Mini usage in March 2010 were:
Russia, Indonesia, India, China, Ukraine, South Africa, Nigeria, the
United States, Vietnam and the United Kingdom. The top 10 remains
unchanged from the previous month.
iPhone impact preview
Following the launch of the iPhone in mid-April, this month we
preview some of the initial data from Opera Mini's release on the
iPhone. These preliminary numbers will be reviewed in greater depth
when we publish April's numbers next month.
The Apple iPhone is currently the #3 device used by Opera Mini users
worldwide. All the other top 20 devices are Nokia and Sony Ericsson
handsets.
The Apple iPhone is currently the #1 device used by Opera Mini users
in the United States, well ahead of BlackBerry (which previously
occupied the top spot).
Next month's top 10 countries may be in for a change. By mid-April,
due to the iPhone launch, the United States jumped from #8 to #5 in the
top 10 countries list.
Out of the top 10 countries according to Opera Mini usage, the
United States and the United Kingdom are the two countries where the
Apple iPhone has become the #1 device used by Opera Mini users. Beyond
the top 10 countries, Australia, Korea, Canada, Germany and Japan are
other examples of places where the iPhone has become the device of
choice for Opera Mini users.
EU trends
This month's report also looks at mobile Web trends in the European
Union (EU). The top 10 countries using Opera Mini in that region are
the United Kingdom, Poland, Germany, the Czech Republic, Italy,
Romania, Slovakia, Spain, Netherlands and Finland.
Some numbers: From March 2009 to March 2010, page views in the top
10 countries of the EU increased by 82%, unique users increased by 60%
and data transferred increased by 71%.
Growth rates in the EU: Slovakia and Germany lead the top 10
countries of the region in terms of page-view growth (139.7% and
120.8%, respectively). Italy and Romania lead the top 10 countries of
the region in growth of unique users (140.4% and 121.4%, respectively).
Romania leads the top 10 countries of the region in page views per
user, with each user browsing 361 pages on average each month.
In the EU, among mobile Web users, Google is at the top of the
rankings in 9 out of the top 10 countries. In the Czech Republic,
Google is number 2 (behind Seznam).
Opera Mini users in the EU generally prefer Nokia and Sony Ericsson
handsets, with a couple of LG and Samsung phones occasionally showing
up in the handset rankings.
Global handset trends
In Part 4 of the report, we look at look at handsets around the
world and rank them according to unique users of Opera Mini, downloads
of Opera Mini, and page views per user on each device.
- Nokia dominates download and user metrics, while Sony Ericsson
users typically browse the Web more actively with their phones; Sony
Ericsson phones lead in the page-view-per-user metric.
